Marketplace terms
The rules of the market.
Posting a listing is free; when an item sells, Siuslaw Country takes a 1.5% commission on the sale price. These terms apply to everyone who posts, reads, buys, or sells in the Siuslaw Country marketplace, and they include a release of liability that you should read carefully.
In one paragraph
Siuslaw Country is a notice board. We do not own, inspect, store, ship, guarantee, or take payment for anything listed here, and we are not a party to your sale. You deal directly with the other person, at your own risk, and you agree not to hold us liable for anything that goes wrong between you.
01What this market is, and what it is not
Siuslaw Country publishes classified advertisements for people in Florence and the surrounding Siuslaw region. We provide the page the listing appears on. Nothing more.
We do not handle the money between buyer and seller, hold deposits, arrange shipping, verify ownership, inspect condition, or confirm that a seller is who they say they are. There is no escrow, no buyer protection, and no refund on an item. Every sale is between the buyer and the seller alone. The only money we take is our own commission, described in section 13.
02Who may post
You must be at least 18 years old and able to enter a binding contract to post a listing. Information on your account and on your listing must be accurate. You are responsible for everything posted under your account.
03Your listings
Everything you post stays yours. By posting, you give us permission to display, format, and promote that listing on this site and in our own channels for as long as it is up.
You confirm that you lawfully own or may sell what you list, that the description is honest, that photographs are of the actual item, and that the price is what you will actually take. Take the listing down or mark it sold when it is gone. You are responsible for sales tax, permits, licences, and title or registration transfers that apply to what you sell.
04What may not be sold here
This market is not for people. No person may be listed, sold, traded, bartered, given away, raffled, or offered in any other way on Siuslaw Country — not as a worker, a companion, a dependent, a "free to a good home" ad, or under any other description. Listing a human being is human trafficking, and we will remove the listing and report it to law enforcement.
Do not list anything that is illegal to sell, own, or ship, or that requires a licence you do not hold. That includes, without limitation: stolen property; counterfeit goods; drugs and drug paraphernalia; firearms, ammunition, and silencers; recalled or unsafe products; hazardous or flammable materials; live animals sold in violation of law; wildlife and wildlife parts restricted by state or federal rule; alcohol or tobacco offered to minors; sexual content; other people's personal information; event tickets or anything else offered in violation of a third party's terms; and any service that is fraudulent, deceptive, or discriminatory.
No spam, no repeated reposting, no bait prices, no requests to wire money, and no listings designed to collect other people's information. We may remove any listing that breaks these rules, at any time, with or without notice.
05Hold harmless, release, and indemnity
You post, meet, buy, and sell entirely at your own risk. To the fullest extent allowed by law, you release, hold harmless, defend, and indemnify Siuslaw Country, its owner, editors, contributors, and volunteers from and against any and all claims, demands, suits, losses, injuries, damages, costs, and reasonable legal fees arising out of or related to: anything you post or fail to post; any listing, negotiation, meeting, sale, purchase, payment, delivery, transport, or use of an item; any item being defective, unsafe, misdescribed, stolen, or not lawfully the seller's to sell; any act or omission of another user, including fraud, misrepresentation, harassment, or no-show; and any dispute between users.
This release applies even if we have been advised of the possibility of such loss, and it survives the removal of your listing, the closing of your account, and the end of this service. You agree not to bring any claim against us in connection with the marketplace, and you agree to pay our costs if a claim is brought against us because of something you did or posted.
06Assumption of risk
Meeting strangers and buying used goods carries risk. Meet in daylight in a public place, bring someone with you, inspect and test before paying, and never send money or a deposit in advance. Vehicles, boats, trailers, and machinery are sold as-is, where-is, with no warranty of any kind, and you are responsible for checking titles, liens, hull numbers, and registrations before you pay.
07No warranties
The marketplace is offered free, as-is, and as-available. We make no warranty that the site will be uninterrupted or error-free, that a listing is accurate or still available, or that any user is trustworthy. We do not warrant any item listed — merchantability, fitness for a particular purpose, and all other warranties are disclaimed to the extent the law allows.
08Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the marketplace is limited to the greater of one hundred US dollars or the total amount you have paid us in the twelve months before the claim — and because the only thing we charge is a commission on a sale, that amount is ordinarily the commission you have paid. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or loss of data.
09Your contact details are public
The name, email address, and optional phone number you put on a listing are shown to anyone who opens it. Do not post information you want kept private. When you post, we also record which version of these terms you accepted and when you accepted it.
10Moderation and removal
We may edit, hide, or delete any listing, and suspend or close any account, at any time and for any reason, without notice or explanation. We are under no obligation to publish or keep any listing, and refusing or removing one does not entitle you to a refund or a credit of a commission already paid on a sale that went through.
11Disputes between users
Sort it out between yourselves. If someone brings a claim against us because of your listing or your dealings, you agree to take it on and cover our costs, as set out in section 05.
12Governing law, changes, and acceptance
These terms are governed by the laws of the State of Oregon, without regard to conflict of law rules, and any dispute will be heard in the state or federal courts sitting in Lane County, Oregon. If any part of these terms is found unenforceable, the rest stays in force.
We may update these terms at any time. The version you accepted is recorded with your listing. Continuing to use the marketplace after an update means you accept the new terms. This version is dated 2026-10-22-people.
13The sale commission
Posting a listing costs nothing. When an item sells, Siuslaw Country takes a commission of 1.5% of the price the item actually sold for, charged to the seller. Because our payment processor will not accept a charge below fifty cents, the smallest commission we can collect is $0.50.
You settle it by entering the final sale price and marking the listing sold. Until the commission is paid, the listing stays up as available. Giveaways and wanted posts carry no commission. Understating the price you actually took in order to pay less is a breach of these terms.
The commission pays for publishing and keeping the listing. It is not a fee for brokering, inspecting, guaranteeing, or completing your sale, and paying it does not make us a party to the sale or responsible for anything described in section 05.
These terms are written in plain language for a small community classifieds board. They are not legal advice — if the marketplace grows, have an Oregon attorney review them and adapt the wording to how you actually operate.
